These terms are the agreement between you (the business that signs up, "merchant") and gopozz. By creating an account or using gopozz you accept them. Please read them with our Privacy Policy and Refund Policy.

1. The service

gopozz is software, offered as a subscription, that lets a business bill customers at the counter (POS), manage products, stock, purchases, expenses and reports, and run its own online store. Features available to you depend on your plan, as shown on our pricing page.

gopozz is a technology platform. We are not the seller of the goods or services you sell, we are not a party to your sales, and we do not take a commission on them.

2. Your account

• You must be at least 18 and able to enter a contract under Indian law, and you sign up on behalf of a real business.
• Give accurate details and keep them up to date, including any verification (KYC) documents we ask for before your online store goes live.
• Keep your password and one-time codes private. You are responsible for everything done through your account and your staff logins. Tell us at once if you suspect misuse.
• You decide what each staff member can see and do, and you are responsible for their use of gopozz.

3. Plans, trial and payment

• Free trial: new businesses get a free trial for the period shown on our site. No card is needed and nothing is charged during the trial.
• Plans: plans are paid monthly or yearly in advance. Prices are shown on our pricing page and are exclusive of GST, which is added at the applicable rate (currently 18%). We issue a GST invoice for every payment.
• Days are never lost: if you pay while you still have time left on a trial or plan, the new period is added after the time you already have.
• Renewal: plans do not renew automatically unless you choose an automatic payment option. If a plan is not renewed it expires at the end of its period.
• Price changes: we may change prices for future periods. We will tell you at least 30 days before a change affects you; it never changes a period you have already paid for.
• Offers: discounts, "founding" prices and free months apply as described when offered and may be withdrawn for new sign-ups at any time.

4. Your online store and your customers

You are the seller on your store. You are responsible for:

• your products, prices, descriptions, photos and stock, and that you have the right to sell and show them;
• showing your business name, address, contact details, return, refund, delivery and grievance information to your customers, and following the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, the Legal Metrology rules and any other law that applies to what you sell;
• taxes on your sales, including GST registration, invoices and returns;
• delivering orders, handling returns, refunds and complaints from your customers;
• the personal data of your customers, which you control as Data Fiduciary under the DPDP Act. We process it only on your instructions to run your store, as described in our Privacy Policy.

We may review a store before it is published and may refuse or unpublish a store that breaks these terms or the law.

5. Payments to you

Online payments on your store are made through your own account with a payment gateway (such as Razorpay, Cashfree, PhonePe or Paytm) and go directly from your customer to that account. Your relationship with the gateway, including its fees, settlements, chargebacks and refunds, is governed by your agreement with it. gopozz does not hold, collect or settle your money, and charges no commission on your orders. The same applies to courier accounts you connect.

6. Acceptable use

You must not use gopozz to:

• sell anything illegal in India, including prohibited drugs, weapons, counterfeit or stolen goods, or items that need a licence you do not have;
• infringe anyone's trademark, copyright or other rights;
• mislead customers, run fraudulent offers or fake reviews, or send spam;
• upload malware, try to access other businesses' data, probe or overload our systems, or copy or resell gopozz;
• publish content that is defamatory, obscene, hateful, or otherwise unlawful under the Information Technology Act, 2000 and its rules.

7. Your data and content

• Your business data and content remain yours. You give us permission to host, copy, process and display it only as needed to provide gopozz to you.
• You can export your main records (sales, purchases, products and reports) from the dashboard while your account is active and for 90 days after it ends.
• We may use anonymised, aggregated statistics that cannot identify you or your customers to improve the product.

8. AI features

AI features generate text or images automatically and may be inaccurate or unsuitable. Review every output before you publish it; you are responsible for what you publish. AI features may have monthly limits by plan and may change as we develop them.

9. Third-party services

gopozz connects to services run by others, such as payment gateways, couriers, email and SMS providers, maps, social networks and AI providers. Their terms apply to your use of them, and we are not responsible for their availability or actions.

10. Availability and support

We work to keep gopozz available at all times and take regular backups, but we do not guarantee uninterrupted or error-free service. We may carry out maintenance, preferably at quiet hours, and we may change or improve features. Support is provided through the channels and hours listed for your plan.

11. Our intellectual property

The gopozz software, designs, store themes, logos and content (other than yours) belong to us or our licensors. Your subscription gives you a limited, non-transferable right to use them while your plan is active. You may not copy, modify, reverse-engineer or resell them.

12. Suspension, expiry and closing your account

• If your plan expires, you can still sign in and see your data, but adding new sales, purchases and some other actions are paused, and your online store may stop taking orders, until you renew.
• You can stop using gopozz at any time. To close your account and have your data deleted, write to us from your registered email.
• We may suspend or close an account that breaks these terms or the law, puts other users at risk, or does not pay, normally after notice unless the matter is urgent or the law requires otherwise.
• After closure or expiry we keep data for 90 days and then delete it, as described in our Privacy Policy.

13. Disclaimers and liability

• gopozz is provided "as is". To the extent the law allows, we disclaim implied warranties, including fitness for a particular purpose.
• We are not liable for indirect or consequential losses, such as lost profits, lost sales or lost data that you could have exported, or for the acts of your customers, staff, payment gateways or couriers.
• Our total liability to you for any claim is limited to the amount you paid us for gopozz in the 12 months before the claim.
• Nothing in these terms limits liability that cannot be limited under Indian law.

14. Indemnity

You agree to compensate us for claims, penalties and costs arising from the goods or services you sell, your content, your dealings with your customers, or your breach of these terms or the law.

15. Governing law and disputes

These terms are governed by the laws of India. Subject to the next sentence, the courts of India have jurisdiction. Before going to court, please contact our Grievance Officer so we can try to resolve the matter in good faith within 30 days.

16. Changes to these terms

We may update these terms. We will change the "Last updated" date and, for significant changes, tell you by email or in the dashboard at least 15 days before they take effect. If you keep using gopozz after that, the new terms apply; if you do not agree, you may stop using it and ask for any refund due under our Refund Policy.
